From Times of San Diego;

A one-time high school and college football star accused of driving under the influence of drugs and causing a crash that killed a Caltrans subcontractor on a North County freeway onramp pleaded not guilty Wednesday to gross vehicular manslaughter and DUI charges.

Reginald Grigsby Jr., 31, was ordered held on $750,000 bail and faces up to 10 years in state prison if convicted of the felony counts, said Deputy District Attorney Aimee McLeod. Grigsby was was under the influence of a “central nervous system depressant” when he lost control of his Mitsubishi Montero on the connector from South Centre City Parkway to southbound Interstate 15 in Escondido shortly after 2 p.m. Monday, the prosecutor alleged.

The vehicle veered off the roadway, rolled down a slope and struck Murrieta resident Leonardo Sandoval, who was repairing a sprinkler system in a median next to the freeway entrance.

Sandoval, the 21-year-old father of a year-old boy and an employee of Perris-based Pacific Restoration Group, died at the scene.

The SUV overturned before coming to rest on its roof next to a off-ramp from northbound I-15. ….MORE

On one side of the courtroom sat Thomas Muir’s friends and family – his parents, grandparents and siblings – there to show their support for the accused. Sam Ellis will face double DUI rap for deaths of Calvin Li and Alex Murk

NORTH POTOMAC, Md. (WUSA9) — A parent was present at an alcohol-fueled party in North Potomac that led to a fatal car crash in June, according to documents obtained by WUSA9.

The documents also show that the car carrying Alex Murk, Calvin Li, Sam Ellis and Cameron Siasi was also traveling at least more than 30 miles above the speed limit before the crash.

The four were leaving a house party on June 25 on Dufief Mill Road in North Potomac when their car, driven by Ellis, flew into a fence, hit a tree and landed upside down in a nearby yard. Murk and Li, both riding in the back seat, were killed in the accident. Ellis and Siasi, who was the front-seat passenger, both suffered serious injuries.

The documents show that Ellis was driving at a minimum speed of 65 miles per hour in a 35 mile per hour zone. In an interview with investigators, Siasi said he saw the speedometer at 105 miles per hour and said “Sam’s eyes widened” and “Calvin let out a faint scream.”

PREVIOUS STORY: Police release names of N Potomac crash victims

“We know he was going at least 65 miles an hour and probably much, much more. He was on the wrong side of the road, trying to go around the speed camera,” Montgomery County Police Captain Tom Didone said.

An investigation indicated that Ellis’ car was traveling southbound in the northbound lane on Dufief Mill Road. Siasi told investigators that Ellis, 18, was worried about getting a ticket from a nearby speed camera and someone in the car said ‘if you go fast enough, the camera won’t get you.’

Police had previously said Murk and Li were not wearing seatbelts. Both of the front-seat passengers were wearing seatbelts.

“When parents are hosting parties and kids are going to drink, they’re going to drink more. And bad things occur,” Didone said.

Sources confirm to WUSA9 that the party was held at the home of Kenneth Saltzman, whose daughter was the host. Documents reveal that one partygoer brought two 30-packs of beer and Salzman jokingly asked if one of those cases was for him.

All of the alcohol for the party was bought at a liquor store in Rockville, sources say. Some of that alcohol was purchased by a teenage boy with what sources describe as “a very good fake ID.” The rest of the alcohol was bought by a 21-year-old sibling of one of the partygoers.

“It’s not a kiddie crime. It is something very serious. We hear about these consequences all the time so parents need to have that family discussion,” Didone said.

Documents show Ellis’ blood alcohol level was a .09 at a hospital two hours after the crash. Later, using a state police kit, it was a .07.  For adults, the legal limit of intoxication is .08.

According to the documents, Ellis also tested positive for marijuana and benzodiazepines, which is found in medications like Xanax.

In their investigation, police encountered difficulties getting community members to provide any information. Police had to subpoena more than a dozen teenagers to testify before a grand jury and sources say as many of three-quarters of them lawyered up. The teens agreed to provide information to police on the promise of immunity. ….MORE

MIAMI (10/02/2015) — A South Florida musician who killed two people in a crash two years ago was found guilty by a jury on Friday.

vehicle at a red light at Douglas Road. Maria Martinez and her boyfriend, Marlon Gutierrez, were inside the vehicle  he struck. They died on scene.

On Friday, the 28-year-old was found guilty on four counts of DUI and vehicular manslaughter. “After two years and four months, we’re finally getting the justice we’re searching for,” said Yuri Blen, Martinez’s daughter.

Prudent’s attorney argued that the driver fell asleep behind the wheel, but surveillance video of the accident showed him dodging and speeding along the street. Police also said Prudent was drinking prior to the accident, and three hours after, his blood alcohol level was .115, far beyond the .08 limit.

From Miami Herald:

Despite blood test results, Prudent swore he wasn’t drunk that night. Instead, the DJ and musician insisted he fell asleep behind the wheel after a long day that included a funeral, a restaurant shift, errands and dancing at a friend’s wedding before driving off for home.

“I was doing the speed limit and then,” Prudent told jurors. “Next thing I remember is waking up at the hospital.”

But a witness noted Prudent was honking and changing lanes as he barreled down Southwest Eighth Street. The jury also saw video surveillance footage of the violent impact when Prudent’s Toyota Corolla plowed at a high rate of speed into Maria Martinez, 44, and Marlon Gutierrez, 34, who were stopped at a red light.

And three hours after the June 2013 crash, a test showed Prudent’s blood-alcohol-content level was still .115 — far over the legal limit of .08.

“You’re coming fast, beeping your horn repeatedly. Kind of difficult to do that if you’re asleep,” Miami-Dade prosecutor Lara Penn said during cross-examination. “You managed to keep yourself driving, never drifting, never veering off the road, while you’ve fallen asleep?”

She asked: “Cars don’t just move on their own, correct? You have to hit the gas pedal, right?”

“Yes,” Prudent replied softly….MORE

Carol Fedigan entered guilty plea and boozing again

The complete narrative of the charges filed by King County prosecutor and chain of events in horrible fatal crash through home reveals Fedigan’s family had intervention to try to get her treatment for her booze and drugs problem.

From King News

Holding back the tears is hard for Betty Halley. Her family has been suffering ever since the loss of David Walker.

David’s wife, Carol Sue Fedigan, plead guilty for what happened May 16, 2014 – the night her Jeep could be seen dangling over Lake Sammamish.

Police say she was moving her car across the street and into her driveway, but she ended up crashing through her house.

At the time she had her toddler grandson in her lap, unrestrained. They were both okay, but inside the home, at the dining room table, Fedigan’s daughter, son-in-law, and husband were in her path of destruction, and only her daughter survived.

Court documents state Fedigan had taken the sleeping aid Ambien and had been drinking wine prior to the crash.

The court allowed for her release until her sentencing day, with the condition that she not drink, but a monitoring device detected alcohol from October 5-7, with blood alcohol concentration peaking at .16.

ST. PETERSBURG, Fla. ( 10/16/2015) — St. Petersburg Poice report that mayhem broke out as they attempted to investigate a crash when four DUI drivers  showed up. Police say that four separate drivers were arrested for DUI after they tried to drive through a car vs. motorcycle crash scene.

Last night at 11:45 p.m. David Flores-Vega turned his motorcycle in front of a car at 9th Ave North and 66th Street North.

When the car clipped the motorcycle, Flores-Vega was thrown into the windshield and then over the car onto the pavement. The motorcycle then rotated and struck the driver door of the car.

Flores-Vega was wearing a helmet and appeared to have been drinking. He was transported to Bayfront in critical condition but died from his injuries this morning.

While this crash was being investigated an elderly driver, who was not believed to be impaired, struck one of the cruisers that was unoccupied. No one was injured.

Over the course of the investigation, four separate drivers approached the scene impaired. They were arrested for DUI and because they attempted to drive through the scene.

In addition, four other drivers face DUI charges after police say they were impaired as they attempted to drive through the investigation scene: Mechelle Darlene Gould, 28; David Tyler Payne, 23; Benjamin H. Emmons, 22 (also facing a charge of cocaine possession); and Joachim Michael Kohlhase, 49 (also facing a charge of cocaine possession).

Virginia: Charles Fife held on manslaughter DUI charges after killing Kevin Harrah

Charles Fife had plenty of DUI practice before killing Kevin Harrah

From NBC 4 Washington:

A newlywed Virginia man driving home from work last month was killed in a crash with a man who lost his license because of a drunken driving conviction earlier this year.

Kevin Harrah, 27, who married 24-year-old Amanda Sharpe just more than a year ago, had just closed a Pizza Hut in Stafford the night of Sept. 16 when his car was struck from behind by 59-year-old Charles R. Fife on Route 1 near Manning Drive, police said. Fife was intoxicated, according to police.

When Fife lost his license earlier this year, he requested and was given restricted driving privileges.

Stafford County Commonwealth’s Attorney Eric Olsen charged Fife with involuntary manslaughter at first but recently increased the charge to aggravated manslaughter.

“We determined speed was a significant factor,” Olsen said. “He hadn’t applied the brakes before the accident. He was driving on a suspended license because of a prior DWI. And he should have had an ignition interlock in the car, which would have kept him from driving if he had any alcohol.”

A Virginia State Police trooper learned Fife may have been sending and receiving text messages around the time of the crash and got a search warrant for Fife’s phone.

If convicted of aggravated manslaughter, Fife faces the possibility of 20 years in prison.

Obituary of Kevin Daniel Harrah, 27, of Fredericksburg was taken from us, well before his time, on Wednesday, Sept. 16, 2015.

There are no words to describe how many lives Kevin touched with his kind heart and radiant smile. Kevin never met anyone who was not eventually a friend. Kevin loved cars, from detailing to helping lead his car club, Quantico SRT. Kevin worked hard at both work and play, and had love and passion for both. He will be missed by all.

Kevin touched many lives and will be missed by all those with whom he came into contact. These include his wife, Amanda; his parents, Danny and Retha Harrah; his brother, Randy; grandmother Neoma Powers; grandfather CC Ogden; Aunt Lula and Uncle Marshall Naylor; and extended family from California to Virginia.

Donations in Kevin’s memory may be made in person or over the phone to “Kevin Harrah’s Memorial Fund”, an account at Wells Fargo. No additional account information is required

From the Facebook page of Stafford County Commonwealth Attorney Eric Olsen:

As your Commonwealth’s Attorney, I have taken a firm stance against drunk driving in Stafford County. Unlike some other jurisdictions I am aware of (other localities in Virginia, Maryland, DC, for example), the Stafford Commonwealth’s Attorney’s Office refuses the practice of routinely reducing drunk driving charges to reckless driving. We take these cases seriously and prosecute drunk driving cases aggressively. I insist on it. I believe that drunk driving is an important safety issue for our community and for all Virginians. Just look at the statistics above (taken from MADD website). Driving under the influence cannot be tolerated and as long as I am your Commonwealth’s Attorney it won’t be tolerated in Stafford County.

SAN DIEGO, CALIF. — 10/23/2015 – An alleged drunken driver accused of going the wrong way on Interstate 15 between Mira Mesa and Scripps Ranch, causing a head-on crash that killed two of five family members in the other car, was ordered Thursday to stand trial on charges of gross vehicular manslaughter while intoxicated and DUI causing injury.

Shane Gerald McDonald, 22, faces nearly 16 years in state prison if convicted, Deputy District Attorney Cally Bright said.

McDonald — who is out of custody on $500,000 bail — had his trial set for April.

Authorities said Rodolfo de la Torre, 55, and Teresa Esparza Hernandez, 84, both of Escondido, were killed when a black Audi driven by McDonald slammed into their Honda sedan about 3 a.m. on May 2, south of Mercy Road.

De la Torre was driving south in an I-15 express lane when the Audi, heading north in their lane, hit the Honda head-on, according to the California Highway Patrol. Three other family members in the back seat of the Honda suffered major injuries.

McDonald’s attorney, Cole Casey, argued to Superior Court Judge Kenneth So during a preliminary hearing that the defendant to be held to answer on charges of vehicular manslaughter with ordinary negligence, not gross negligence.

Casey said McDonald entered the express lane….MORE

From KSAT:

A fourth person has died after a car hit spectators during Oklahoma State University’s homecoming parade in Stillwater. A 2-year-old died at OU Medical Center Children’s Hospital in Oklahoma City, hospital spokeswoman Vallery Brown told CNN. Forty-four people suffered injuries in the incident.

A woman suspected of drunken driving crashed a car into a crowd of spectators at Oklahoma State University’s homecoming parade, killing three people, authorities in Stillwater said Saturday.

Another thirty-four people were injured, eight of them critically, according to a police spokesman. Seven of those eight were taken by helicopter to a hospital, while 10 spectators — one critical and nine “seriously injured persons” — were taken by ambulance. Another 17 “walking wounded” took themselves to the hospital, according to Capt. Kyle Gibbs.

The names of those killed and injured weren’t immediately released.

Gibbs said the car’s driver, Adacia Avery Chambers of Stillwater, was arrested at the scene on suspicion of driving under the influence and taken to the city jail. She is not believed to be an OSU student, he said.

According to a police statement, Chambers drove her 2014 Hyundai Elantra into an unmanned police motorcycle before careening into the crowd of spectators.

When asked by a reporter whether the 25-year-old Chambers was “obviously intoxicated,” Gibbs said, “Certainly probable cause for the arrest, yes sir.”

Gibbs said that Oklahoma state law mandates blood tests for any “serious fatality accident.” The results of those tests won’t be known for several days, he said.

The deadly crash occurred at 10:31 a.m. (11:31 ET), just hours before the school’s centerpiece homecoming event — a football game between the nationally ranked, undefeated OSU Cowboys and the University of Kansas — and only two blocks from the soon-to-be jam packed 50,000-person Boone Pickens Stadium.

The festive scene turned into one of horror, one the university president called a “horrible tragedy.”

“We are shocked and heartbroken by this horrible tragedy,” said President V. Burns Hargis. “The Oklahoma State University Homecoming parade is the most wholesome of events and to have it marred in such a way is incomprehensible.” ....MORE

A Moore Township teen admitted Friday to killing two people while driving high on cough syrup, under a plea agreement in which he will face eight to 16 years in state prison at sentencing.

He tested positive for DXM, an over-the-counter cough suppressant sometimes known as “poor man’s PCP,” as well as synthetic marijuana.

Hearing the circumstances of the Nov. 9, 2014 wreck, Northampton County Judge F.P. Kimberly McFadden appeared taken aback.

“Those facts are very disturbing to me. I’m sure they are to you as well,” McFadden told Creyer, a small young man who stood before her in handcuffs and a prison jumpsuit. “You’re going to have to live with this for the rest of your live.”

McFadden added, “It’s every parent’s, and person’s, nightmare.”

Creyer admitted to two counts of homicide by vehicle, one of aggravated assault by vehicle and one of driving while intoxicated. Assistant District Attorney Joseph Lupackino said the eight- to 16-year term is part of the agreement between him and defense attorney Rory Driscole. ….MORE

CEDAR HILL, TN (10/30/2015) –The parents of a teen killed in a crash in Robertson County have a warning for other young people.

Landon Ross, 17, passed away when his pick-up truck went off Flewellyn Road and hit a tree Saturday night.

A preliminary report by the Tennessee Highway Patrol claims drugs and alcohol were involved in the crash and Landon Ross was not wearing a seat belt, though the cause of the crash is still under investigation.

“We know where Landon is right now,” said Dell Ross, Landon Ross’s mother. “We’re in the peace that he’s in heaven with the one person who loves him unconditionally, and that’s Jesus Christ.”

David and Dell Ross of Cedar Hill said the values they’ve instilled in their three sons start with the importance of a strong work ethic and church.

“If you didn’t get in here to church, you were going to be home all day Sunday,” said Dell Ross, sharing the family rules.

Family members said Landon Ross lived by those values. His family said he worked hard at Pleasant View Feed Mill, studied hard at Springfield High, but all the while, had the quick wit to know just what to say to get the room laughing.

“To hear people talk about Landon, those words of how he was away from home have been a blessing to me,” said Dell Ross.

“Far as we know, he was looking off, distracted for whatever reason,” said David Ross, Landon’s father, referring to the crash. “That’s a big thing these days, distracted driving. Do not make the mistake of letting peer pressure cause you harm. Life’s precious, and it’s short. For any young person out there that’s starting to learn, starting to drive, better take it serious and get real because it will cost you your life.”….Read more:
