Maryland: Sam Ellis charged with homicide for killing Alex Murk and Calvin Li in DUI crash

Sam Ellis will face double DUI rap for deaths of Calvin Li and Alex Murk

ROCKVILLE, MD. — Samuel Joseph Ellis has been indicted by a Montgomery County Circuit Court Grand Jury on seven counts of negligent manslaughter, negligent homicide and causing life-threatening injury for killing Alex Murk and Calvin Li,  two of his high-school friends in a DUI crash in North Potomac last June.

Ellis faces Judge John W. Debelius III on Nov. 20, 2015 for a scheduling hearing.  A video bench warrant hearing was held on Nov. 6, 2015 at 1:30 pm before Judge Cynthia Callahan. Ellis, of 14609 Snapdragon Circle in North Potomac, Md.,

Ellis also faces a criminal hearing on Nov. 18, 2015 in Ocean City from charges brought by Ocean City Police Officer R. Flanagan for being involved in a fight on June 2, 2015. A civil citation for possession of alcohol under the legal age on March 15, 2015 was dropped by Montgomery County States Attorney John McCarthy on June 9, 2015.

Kenneth Saltzman, a parent who was at the party on 14600 Boat House Way in North Potomac, and whom hosted the teen party, was charged on Oct. 28, 2015 with furnishing alcohol to a minor. He faces trial in District Court for Montgomery County on Dec. 10, 2015.

Montgomery County States Attorney McCarthy dumped the alcohol charge

ROCKVILLE, MD. — The driver who police say killed two of his passengers while on a high-speed booze cruise after a teenage drinking party was busy racking up a record of alcohol and fighting in two Maryland counties in recent months.

While Samuel Joseph Ellis, of 14609 Snapdragon Circle in North Potomac Maryland rests up in his hospital bed from injuries which were apparently self-inflicted by his reported speeding into the grounds of a home after a teen drinking party; an examination of his court record shows a civil citation for underage possession of alcohol was served on him by Montgomery County Police Officer N. Culler on March 15, 2015.

The incident of underage alcohol was just three months prior to the fatal crash in which police say he killed two of his school chums. Dead are Alexander Murk and Calvin Jaixing Li, both recent graduates of Wooten High School.

On June 9, 2015, the Montgomery County States Attorney John McCarthy dropped the citation, which carried no criminal record but did have a fine payable of $100.  The court record doesn’t show any public service assessed in lieu of the fine.

On June 2, 2015 the party boy Sam Ellis was reveling in Ocean City, Maryland along with thousands of other newly graduated high school students when he was arrested by Ocean City Police Officer R. Flanagan.  The criminal charge which is pending in Worcester County District Court for a hearing on July 9, 2015 is for the criminal charge of “affray”, which means participating in a fight among several persons, often associated with a riot or rumble.

Arrested at the same time as Ellis was one of the teens who died in the crash, Calvin Jaixing Li, of 2326 McCormack Rd. in Rockville, Md. The pair were charged by Ocean City Police in a June 2, 2015 2:27 am incident which took place at 6007 Coastal Highway.

Court records show that Rockville attorney Brian Clark represented Li and has filed an order with the Worcester County District Court on June 29th for abatement of the charge due to Li’s death.

Montgomery County lawyer and former Delegate Robin Ficker made this comment on aWashington Post article about the double fatal teen crash:

“Just this past week in Montgomery County Circuit Court, Vincent Olalo was sentenced to 3 years in jail by Judge Mason because his drunk driving accident contributed to the death of a man who already had very serious health problems. Let’s see if States Attorney McCarthy administers justice even-handedly.”

Coverage from WUSA9 News

NORTH POTOMAC, Md. Sept. 22, 2015 – (WUSA9) — The family of one of two 18-year-old Wootton High School graduates killed in a car crash after a party released a statement Monday expressing shock about the news a parent was present for the party, and a desire to make sure the laws change.

The statement by David and Pamela Murk comes days after a WUSA9 report into the investigation into the crash that killed their son Alex Murk and fellow Wootton graduate Calvin Li on June 25. The two were killed after the car they were traveling in flew into a fence, hit a tree and landed in a yard.

READ:
The report on the fatal accident

According to documents obtained by WUSA9, the driver of the car, Sam Ellis, was traveling at least more than 30 miles above the speed limit and has a blood alcohol content of .09 two hours after the crash.

“Needless to say, this has been a lot — almost too much — for us to absorb. The details into what happened that night re-opens fresh wounds and our family is absolutely devastated,” David and Pamela Murk said in the statement.

PREVIOUS STORY:
Sources: Parent was at party that led to fatal N. Potomac crash

The two also expressed disgust at the circumstances at the party, specifically the knowledge that a parent was present at the party. According to sources, Kenneth Saltzman knew about the party his daughter was hosting, and at one point jokingly asked a partygoer if one of the 30-packs of beer they brought was for him.

Salzman is expected to be charged with adult responsibility, but the Murks believe punishment associated with that charge is too little.

“What is even more shocking is the fact that under Maryland law, a first offense for behavior such as Mr. Saltzman’s carries no jail time, but merely a maximum fine of $2500,” the Murks said in the statement. “$2500 for something that results in the death of two young men.”

WEB EXTRA:
Read the full statement from David and Pamela Murk.

The two also call for a change to the laws, specifically the potential punishments that can be held against drivers.

“Slaps on the wrist, or short jail sentences, will NOT deter other teenagers from acting as grossly irresponsibly as Sam Ellis did that night,” the Murks said in the statement.

“It goes without saying, we were extremely disappointed that so many family and friends of Alex and Calvin within our community who had knowledge of what took place that evening, were unwilling to come forward without subpoenas and a Grand Jury proceeding,” the Murks said in the statement.

DRUNK DRIVING COLLISION

At approximately 2:00 AM this morning. December 2, 2015, Lakeport Police Officers were dispatched to the area of N. Main and Ninth Streets to investigate the report of a hit and run vehicle collision involving a sport utility vehicle and a 18 wheeled truck. The reporting party advised that both vehicles were unoccupied.

While enroute to the collision scene, Officers were diverted to the report of an in progress disturbance in front of the Anchorage Inn less than a block away from the collision scene. Officers arrived at the Anchorage Inn and located two intoxicated male subjects, ages 23 & 24, who were both injured and had blood on their skin and clothing. Both subjects denied having any knowledge of the hit and run collision.

The Lakeport Fire Protection District (LFPD) was requested to respond to the scene to check both subject’s injuries while officers also responded to the collision scene to conduct an investigation.

Lakeport California Police Department

Lakeport California Police Department

Officers determined that the unoccupied 18 wheeled rock truck had been parked facing south along the west curb of N. Main Street just south of Ninth Street when a black 2005 Chevrolet Trail Blazer traveling north in the northbound lane of N. Main Street, at a speed estimated to be at least 40 MPH, left its lane and traveled north-west across all lanes of N. Main Street and hit the rock truck head on.

Officers determined that the subjects from the Anchorage Inn call were in fact involved in the collision and had fled the scene immediately after it happened. Both subjects were transported to Sutter Lakeside Hospital for treatment with the driver, identified as Kevin Cody Hermo 23 of Kelseyville, CA, being arrested for felony drunk driving causing injury and felony hit and run with injury. A blood sample was taken from Hermo for testing for drugs or alcohol.

Due to the severity of the injuries sustained by Hermo and the male passenger, Sutter Lakeside staff had them both flown by helicopter to Santa Rosa Memorial Hospital where they currently remain for treatment.

During the investigation, Officers also located approximately two pounds of suspected marijuana in the Trail Blazer which was impounded for further examination and processing for additional evidence.

This investigation is currently ongoing and we are asking that anyone who may have information on this incident to contact Officer Tyler Trouette or Sergeant Gary Basor at 707-263-5491 or by email at ttrouette@lakeportpolice.org or gbasor@lakeportpolice.org

The on-scene investigation by Collision Reconstruction Unit detectives has revealed that Officer Leotta was conducting a traffic stop in the curb lane of northbound Rockville Pike and Edmonston Drive.  During the course of this traffic stop, a 2012 Honda CRV, traveling north on Rockville Pike, first struck Officer Leotta’s marked cruiser and then struck Officer Leotta, who was outside of his vehicle.

The driver of the CRV, identified as Luis Gustavo Reluzco, age 47, of Rolling Meadow Way in Olney, remained at the collision scene.  Luis Reluzco was taken into custody under the suspicion of driving under the influence of alcohol and drugs.  Due to the seriousness of Officer Leotta’s injuries, Reluzco was required by Maryland law to submit to a blood test that will be analyzed for alcohol;  those results are pending.  Collision Reconstruction Unit detectives continue to examine the circumstances of this collision and if charges are to be made, police say that they will be placed after the completion of their investigation.

From NJ.com

OLD BRIDGE – Martell’s Tiki Bar has agreed to settle lawsuits filed over a drunken driving accident two years ago resulting in the death of one of their patrons and the serious injury of another driver.

The bar patron, Ashley Chieco of Wood-Ridge, had been drinking for several hours and left in a vehicle that looked like hers, but was not.

After the accident, two lawsuits were filed in a Middlesex County court against the popular shore bar – one by Chieco’s family, the other by the injured driver.

Martell’s lawyers agreed to resolve the lawsuits in open court earlier this month, two attorneys involved in the case said Wednesday.

In an agreement with the judge, the attorneys and their clients have agreed not to disclose monetary amounts. Martell’s admitted no wrongdoing by settling the suits, the attorneys said.

Attorney Peter D. Manahan, who represents Martell’s, did not return several calls seeking comment.

“Martell’s did the right thing,” said attorney Paul Edelstein, who represents Dana Corrar of Old Bridge. “Dana was compensated adequately and fairly.”

Corrar, 57, was driving home from work Aug. 16, 2013 when she collided with an SUV that Chieco was driving the wrong way on Route 18 near the County Road 516 overpass.

Several drivers called 911 to report an erratic, wrong-way driver moments before the crash. ….MORE

From Car Crash Detective:

Dana Corrar maimed by drunk driver Ashley Chieco who left Martell's Tiki Bar

Dana Corrar maimed by drunk driver Ashley Chieco who left Martell’s Tiki Bar

Why:
This is another sad case of alcohol use leading to a fatality, as are 1 of every 3 traffic deaths in this country, year after year.

So many things went wrong that night, but I find myself siding with the suit against the bar. It is incredibly irresponsible to serve alcohol in a location where patrons are asked to leave their keys in their vehicles, and it would have been impossible not to notice a person as inebriated as Chieco was not capable of driving a vehicle. She should not have been allowed to enter any vehicles that night, and while she was ultimately responsible for her tragic death and the injuries imparted to Corrar, she would not have been in a position to drive away had the bar spent less time serving her alcohol and more time ensuring individuals were not allowed to drive away under the influence. A bar capable of tracking individuals’ tabs in order to obtain payment before patrons left is certainly a bar capable of calculating when individuals would not legally be capable of driving. Additionally, it is against the law to serve alcohol to patrons who are already drunk, and has been for decades. ….MORE

“As a former lawyer, this defendant’s blatant disregard for not only our City’s laws but public safety, is particularly egregious,” said District Attorney Vance. “Pedestrians, cyclists, and drivers alike were endangered when Stella Mednik took the wheel in an extremely intoxicated state. Miraculously, no one was killed, but five innocent pedestrians were injured, including multiple with broken bones, by Ms. Mednik’s extraordinarily reckless decision to drive while under the influence of alcohol and crack cocaine.”

According to the defendant’s guilty plea and statements made on the record in court, at approximately 10:00 p.m. on December 10, 2014, MEDNIK crashed into a vehicle while traveling eastbound on West 34th Street near Sixth Avenue while impaired by alcohol and crack cocaine. Attempting to leave the scene, MEDNIK drove the wrong direction on West 34th Street and crossed Sixth Avenue, before attempting to re-enter the eastbound lane. MEDNIK hit a second vehicle and then drove onto the sidewalk, where she struck five pedestrians, pinning one woman against a building. Two of the victims suffered broken bones, and others were treated for back and neck pain. Two pipes with crack cocaine residue were recovered from MEDNIK’s car by NYPD officers. At the time of the crash, MEDNIK was driving with a suspended license.
