A man charged with gross vehicular manslaughter and driving under the influence was arrested on suspicion of driving while high on either methadone or heroin, according to California Highway Patrol reports that were handed into the Kern County District Attorney’s office.

Jose Alfredo Garcia, 54, and his wife were on their way home to McFarland from Golden Mountain Casino in Porterville. The two were about 10 miles away from their house when Garcia crashed his Lexus into a pole near Cecil Avenue in Delano.

Garcia was taken to a local hospital with a broken left collarbone and a broken right heel, but his wife did not survive. She was later identified as 53-year-old Rosa Maria Trejo.

According to CHP reports, Garcia at first lied about being being the wheel. Officers said that Garcia gave them a “fictional” name, but they knew Garcia was the driver based off of the injuries he sustained in the crash. Garcia later admitted to being the driver, according to the reports.

Officers wrote that Garcia’s pupils were “constricted,” he was “nodding off,” and that his speech was “slow/slurred.”

“Garcia never asked about the condition of his wife,” wrote CHP Officer Hector Organista in the report. “I had to keep nudging Garcia to keep his attention on me.” ....MORE

Kern County District Attorney Lisa Green announced on Dec. 15, 2015, a conviction in a significant case.

Green said that on January 3, 2014, at approximately 3:00 a.m., the defendant, Alex Rubio, was intoxicated with a blood alcohol concentration nearly twice the legal limit when he raced his car, a 2014 Chrysler 300, down New Stine Rd. and through a solid red light at a speed of 1 1 8 mph. The result was a collision with 22-year-old Princess Almonidovar, who died instantly.

Following the collision, defendant Rubio fled the scene on foot and hid until he was located by officers. When he was located, he led officers on a foot pursuit before being apprehended. After his apprehension, he made several spontaneous statements to officers reflecting his profound indifference to human life. One such statement came in the form of a question to one of the arresting officers: “How bad did that chick f* ** up my car?” The defendant’s blood alcohol concentration was determined by both an evidentiary breath machine as well as by blood draw. Even three and four hours after the collision, the results were a .14 and .13, respectively.

On December 15, 2015, the defendant was convicted by a jury on the following charges and allegations: Second degree murder, gross vehicular manslaughter, DUI with injury and causing great bodily injury, hit and run resulting in death, and resisting arrest. He is scheduled for sentencing on January 14, 2016, before the Honorable Charles R. Brehmer. The case was prosecuted by Deputy District Attorney Jim Simson.

From Bakersfield.com

Court documents state Rubio and Almonidovar were both driving under the influence. Her blood alcohol content was 0.12 percent, according to the documents.

A respiratory therapist at San Joaquin Community Hospital, Almonidovar was the primary breadwinner for her family.

The data box retrieved from the Chrysler showed Rubio was traveling south on New Stine at 111 mph five seconds before the crash, the documents state. That speed kept increasing until it reached 128 mph at impact.

Rubio made no attempt to brake. Police said the accelerator was pressed to the floor at the moment of impact…..MORE

02/01/2016  – On Saturday night, Jan. 31, 2016, Washington County Sheriff’s Deputies serving the city of Cornelius responded to a hit and run crash involving a parked van. The investigation lead them to a Cornelius man who deputies arrested for DUII.

On Saturday, January 30, 2016, at 9:19 p.m., Deputies responded to a hit and run on South Dogwood Street in Cornelius. A witness described hearing the crash and seeing a red pickup truck with a canopy driving away.

A few minutes later, dispatch received a call from John Nelson, 46, of Cornelius, reporting he was in a crash and the other vehicle left the scene. Deputies responded to Nelson’s home, also on South Dogwood Street. The damage to his pickup was consistent with hitting the parked van just down the street.

As deputies sorted out what happened, they determined Nelson was intoxicated, and he was responsible for crashing into the parked van. He also fled the scene of the crash and called in a false report.

Nelson was arrested for DUII, Reckless Driving, Hit and Run, Criminal Mischief II and Initiating a False Report.

Redding Man Sentenced to Maximum Sentence for Felony Assault with a Vehicle While Driving Under the Influence

Dominic Salvador Ventimiglia 4th DUI intentionally ran down pedestrian Shasta County Calif 020116

Dominic Salvador Ventimiglia 4th DUI intentionally ran down pedestrian Shasta County Calif 020116

REDDING, CALIF. — According to the Shasta County District Attorney, on Feb. 1, 2016, the Honorable Judge William D. Gallagher sentenced Dominic Salvador Ventimiglia, 74, to four years in State Prison for a felony charge in connection with a September 26, 2015, incident wherein the defendant intentionally attempted to ram a pedestrian in a crosswalk, while driving under the influence.

A Shasta County jury found the defendant guilty of one felony count of Assault with a Deadly Weapon: Vehicle, and two misdemeanor counts of Driving Under the Influence on January 6, 2016. The defendant had pled guilty to a related misdemeanor count of driving while his license was suspended due to a prior DUI conviction before the jury trial began. Following the jury’s verdict, the court found true two enhancements alleging prior DUI convictions within the past 10 years, and found the defendant in violation of his prior grant of probation.

The defendant has suffered three prior DUI convictions in 2005, 2010, and 2014, and was on probation for DUI at the time of this offense. Two of the defendant’s three priors involved collisions and two also involved blood alcohol levels well in excess of 0.15%. Citing the defendant’s concerning criminal history demonstrating an “unremitting alcohol addiction” that continually placed the public in danger, the defendant’s complete lack of remorse and attitude of defiance toward past court orders, and the shocking circumstances of the current case, Judge Gallagher told the defendant that he had “crossed a line” that society does not look lightly upon as he handed down the maximum sentence allowed by law.

Following an afternoon of drinking at a local bar, the defendant got behind the wheel of his vehicle, despite having a suspended license and probation terms prohibiting the consumption of alcohol. As the defendant was headed westbound on Parkview Avenue, he nearly struck a pedestrian who was in the process of crossing Parkview Avenue northbound in a marked crosswalk. The pedestrian yelled out to the defendant in anger over the near collision. At that point, the defendant sped forward, made an illegal U-turn striking the south curb of the roadway, and then drove his vehicle eastbound into the westbound lanes of traffic in an attempt to intentionally strike the pedestrian who was finishing his trek across the roadway.

The victim was able to jump out of the way, claiming the defendant’s vehicle merely “nicked” his knee. The defendant then proceeded out of his vehicle, wielding his cane in the air, and chased after the victim and several witnesses, prompting numerous 9-1-1 calls. Several officers from the Redding Police Department responded and, following an investigation, arrested the defendant, who was found to have a blood-alcohol content of 0.14%.

The case was investigated by Officer Peggy Porter, Officer Jamie Rouland and Officer Jeff Schmidt of the Redding Police Department and prosecuted by Deputy District Attorney Laura Smith from the Shasta County District Attorney’s Office.

This case was prosecuted under a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration.

Phoenix, Ariz. — State detectives are still combing through the tragic details related to the rear-end crash that claimed the life of 57-year-old motorcyclist Dennis Oddo, a valley resident.

The collision occurred at about 12:15 a.m. on Monday, February 16, when 33-year-old Leith Monroe was driving the car that struck Dennis Oddo as he was riding to work on his Harley Davidson motorcycle southbound along I-17 near Happy Valley Road. Mr. Oddo succumbed to his injuries at Honor Health North Mountain Hospital about two hours later.

The impact also forced the motorcycle and Mr. Oddo into the right dirt shoulder, a considerable distance from the point of impact. Monroe continued driving for a tenth of a mile before stopping near the Pinnacle Peak Road off-ramp.

A witness stopped with Mr. Oddo to render first aid and CPR until the Phoenix Fire Department arrived on scene and took over. That is when Mr. Oddo was transported to the hospital with mortal wounds.

Monroe was combative and overall uncooperative with state troopers and detectives. She was taken into custody and booked into the county jail under charges of 2nd-degree murder and criminal damage. The DUI portion of the investigation is still underway.

“The message ‘if you see something, say something’ has never been more appropriate as this case. If you see erratic driving, call it in. Get a police officer or trooper the information to find and stop these drivers before they crash and kill other people, and tragically change lives forever,” said Sgt. Alan Haywood, a supervising detective with the Vehicular Crimes Unit (VCU).

Leith Monroe DWI fatal crash Maricopa County Sheriff Prior Offender

A woman involved in a Phoenix freeway wreck that left a motorcyclist dead was driving drunk at the time of the crash, according to Arizona Department of Public Safety officials.

Leith Monroe, 33, is facing charges of second-degree murder and driving while under the influence after her car rear-ended a motorcycle early Tuesday morning on Interstate 17 near Happy Valley Road, according to court documents.

The motorcyclist, Dennis Oddo, 57, died at a hospital from his injuries.

DPS troopers found several empty bottles of alcohol in Monroe’s car at the scene. A witness to the crash said Monroe appeared to “stumble around” when she got out of her car.

Troopers said Monroe resisted arrest and attempted to take the needle out of her arm when receiving a blood test.

Monroe, of the Many Farms community on the Navajo Reservation, has a prior history of DUI charges and resisting arrest, according to court documents. Her driver’s license had been suspended for a DUI conviction.    .…MORE

From Pasadena Star News

PASADENA >> A drunken driver ran from the scene of an early-morning crash on the 134 Freeway in Pasadena that left a Monrovia man dead, authorities said.

Eduardo Macias, 24, of Pasadena was found and arrested about two hours after the 1 a.m. crash on the eastbound 134 Freeway, just west of Orange Grove Boulevard and the 210 Freeway, California Highway Patrol officials said in a written statement.

Killed was a 41-year-old Monrovia man, officials said. His identity was not released Sunday.

Officials responded to reports of a multi-vehicle wreck and found a crash involving three vehicles, described as a 1998 Toyota, a 1992 Toyota and a 2016 Honda, according to the CHP.

Pasadena Fire Department paramedics pronounced the driver of the 1992 Toyota dead at the scene, officials said. Two 18-year-old women inside the Honda were treated for injuries not believed to be serious.

The driver of the 1998 Toyota — later identified as Macias — fled from the scene on foot, according to the CHP statement.

CHP officers found and arrested Macias about two hours later, CHP Officer Monica Posada said.

After examination at a hospital, Macias was expected to be booked for felony drunken driving, she said. Additional charges, such as hit-and-run, may be sought by prosecutors later as well. ...MORE

Paramedics arriving at the scene pronounced 41-year-old Christopher Richard Nelson dead at the scene. The coroner’s office didn’t have his city of residence, but the CHP reported he was from Monrovia and was driving a 1992 Toyota.

Drunk Driver Sentenced to Three Years in Prison for Manslaughter in Fatal Car Crash

Crash Victim Died After Eight Months in a Coma

Greenbelt, Maryland – U.S. District Judge Paul W. Grimm sentenced Carlos Arnulfo Chacon Chacon, age 42, of Laurel, Maryland on Feb. 18, 2016, to three years in prison followed by one year of supervised release for manslaughter by vehicle – criminal negligence, driving under the influence of alcohol, driving an uninsured vehicle, reckless driving, and failure to drive in a single lane charges.

The sentence was announced by United States Attorney for the District of Maryland Rod J. Rosenstein and Chief of Police Robert D. MacLean of the U.S. Park Police.

According to his plea agreement, at about midnight on February 1, 2014, Chacon Chacon, who was in the United States illegally, was driving a Toyota Celica northbound on the Baltimore-Washington Parkway. Two motorists noticed that he was driving erratically, weaving across the road and leaving the travel lanes as he went onto the shoulder.  They called 911.  As one of the witnesses was speaking with the 911 operator, Chacon Chacon crashed his car into a Mitsubishi traveling northbound in the right lane, on a straight area of the highway.

The Mitsubishi went over a stone wall and then went airborne, striking a tree and causing its roof to collapse down into the passenger compartment.  Chacon Chacon’s car struck the stone wall, spun around, and struck the stone wall a second time, finally coming to rest partially in the highway, perpendicular to oncoming traffic.

At the accident scene, Chacon Chacon was able to walk away from his vehicle and spoke with police and emergency medical technicians.  He twice declined medical treatment and admitted to drinking six beers shortly before driving.  He was under the influence of alcohol, with a blood-alcohol level of .17 percent. A case of beer was in the back seat of his car. His car was not insured.

Emergency medical services cut open the Mitsubishi and extracted the driver, Yolanda Michelle Holt, age 36, of Columbia, Maryland, who sustained extreme head trauma and experienced cardiac arrest.  Ms. Holt remained hospitalized in a coma for nearly eight months and died on September 22, 2014.  Ms. Holt, a District of Columbia public school employee, left behind three children.

United States Attorney Rod J. Rosenstein commended the U.S. Park Police for its work in the investigation and thanked Assistant U.S. Attorney Hollis Raphael Weisman and Special Assistant United States Attorney Gustav William Eyler, of the U.S. Justice Department, who prosecuted the case.

Maryland: DWI killer Kelli Loos snuffed out two lives and now goes back to prison after failing interlock

Back to the slammer for  DUI Killer Kelli Loos

Kelli Loos, of 227 Garden Gate Lane in Annapolis, Md., who killed two men on the Washington Beltway after she had belted down a bottle of wine at the Hamburger Hamlet in Bethesda, Md., has been sent back to jail after she set off the ignition interlock for the third time.  The following is an excellent article that appeared in the Washington Post which gives the background and a report on the latest on this killer. Loos was sentenced by Montgomery County Circuit Court Judge Louise Scrivener to ten years in prison for manslaughter and then set free on parole as the parole board didn’t consider her crime, under Maryland law, to be violent. The Maryland General Assembly is populated by DUI drivers and DUI criminal defense attorney’s who resist efforts to strengthen DUI laws and killers like Kelli Loos behind bars where they can’t kill again.

Bipartisan Maryland DWI legislators

Kelli Loos convicted of double DWI fatal in Fairfax Va in 2009. 3rd

Kelli Loos convicted of double DWI fatal in Fairfax Va in 2009. 3rd

From The Washington Post

March 2 at 7:14 PM
A Maryland woman released early from prison after killing two people in a 2009 drunken-driving crash was sent back to jail Wednesday after an alcohol-sensing “interlock” device stopped her several times from starting her car.

“I don’t know what to do with you. I truly don’t,” an exasperated judge told Kelli Loos, 40, during a hearing in Montgomery County Circuit Court.

Judge Joseph Dugan ordered Loos held without bond for 90 days, at which point he will bring her back for sentencing. Loos and her attorney are advocating she go to a treatment program. Prosecutors want incarceration.

After tripping the device last year, Loos of Annapolis claimed that Altoids breath mints caused the device to indicate alcohol infractions. In court Wednesday, she abandoned the mint claims.

“I made poor decisions,” she told Dugan, adding, “I need help.”

Her case has taken on new resonance in a state in which some lawmakers are pushing to toughen drunken-driving laws and penalties.

Two of the legislative proposals in Maryland: Raise the maximum sentence for vehicular manslaughter convictions, like those in the 2009 Loos case; and require anyone convicted of drunken-driving to install an interlock device, not just those drivers who exceed certain thresholds.

Loos was paroled from prison in 2013, after serving four years of a 10-year sentence. She later was permitted to drive as long as she first blew into an interlock.

At least three times, the device halted her from starting her car when she was legally drunk, prosecutors said. One of the readings was a 0.16, which is twice the legal limit.

“Here she is: She’s back,” prosecutor Mark Anderson said in court Wednesday. “The interlock works or else she’d be driving around at these levels. These levels are ridiculous.”

Loos, a graduate of Virginia Tech University who had worked as a meeting planner, stood for much of the hearing on Wednesday, wiping away tears. Dugan ruled that she violated her probation for two reasons: Drinking, and trying to drive after drinking.  MORE

The 2009 crash devastated the families of two men: Gradys Mendoza and Franklin Manzanares.

Parole Board Chairman told The Post they have to consider all factors!

Because the crimes to which Loos pleaded guilty are considered “nonviolent” under Maryland rules, she became eligible for parole consideration after serving 25 percent of her sentence.

In July 2013, Loos was paroled, having served roughly 40 percent of her sentence. At her parole hearing, Loos was able to show a record of good behavior behind bars, presented herself as remorseful and took responsibility for the crime, said David R. Blumberg, chairman of the Maryland Parole Commission.

“We have to balance all factors, and we try to make our best judgment,” he said.

Hunter Vars and Malachi Davis killed in Kensington NH high speed crash 022916On Monday, February 29, 2016, at approximately 10:05 p.m. the Kensington Police Department was notified of a motor vehicle crash in the area of 246 North Haverhill Road which involved fatal injuries. The initial investigation revealed that a black 2001 Toyota 4-Runner was traveling southbound at a high rate of speed on North Haverhill Road when it failed to negotiate a right-hand curve in the roadway. The Toyota left the roadway striking several trees. This caused the vehicle to roll over several times ejecting all three occupants of the vehicle.

The initial investigation also revealed that two of the occupants sustained life threatening injuries and succumbed to their injuries on scene. The third occupant was transported to Boston Medical Center in Boston, Massachusetts with life-threatening injuries.

The crash investigation is being handled by the State Police Collision Analysis & Reconstruction Unit (C.A.R. Unit) with assistance by the Kensington Police Department and New Hampshire State Police Troop A. Assisting on scene were members of the Kensington Police Department, New Hampshire State Police Troop A, and Kensington Fire & Rescue.

At this time it is unknown if drugs or alcohol were factors; however, all aspects of the crash remain under investigation by the C.A.R. Unit. Anyone that may have further information related to this crash please contact Trooper Thomas Conlon 603-223-8614 or email at thomas.conlon@dos.nh.gov.

UPDATE: MARCH 1, 2016 1100 Hours:

The 3 occupants of the vehicle have been positively identified. Found deceased at the scene were Malachi DAVIS, age 21 of East Kingston, NH and Hunter VARS, age 21 also of East Kingston, NH. Transported by DHART to Boston Medical Center in Boston, Massachusetts was Jack PERREAULT, age 20 of East Kingston where he remains in critical condition.

Alcohol believed factor in Randy Sprague’s crash; charged with DWI after being tracked from scene by K-9

On Saturday, February 27, 2016, at approximately 0219 hours, Trooper Matthew Locke of the New Hampshire State Police Troop A barracks responded to a report of a motor vehicle crash, on Route 101, in the area of Exit 10. Upon arrival Trooper Locke located the subject vehicle in the median facing south, up against the guardrail. The vehicle had sustained significant contact damage as a result of the crash.

Preliminary investigation revealed that Unit #1, a black 2008 Ford Ranger, being operated by Randy Sprague, age 33, of Epping, New Hampshire, was driving westbound when for an unknown reason, he drifted completely off the paved portion of roadway to the right, striking and destroying a “Route 101 West” sign. After striking the sign, Sprague over-corrected to the left, drove across the two westbound lanes of Route 101 and struck the guardrail in the center median head on.  The vehicle came to final rest in the median after striking the guardrail. Witnesses to the crash had seen a male standing by the vehicle just prior to Trooper Locke’s arrival, however, no driver was immediately located. Based on the seriousness of this crash, the extremely cold temperature, and the potential for injuries to the driver, a State Police K-9 was requested to assist in locating the driver.

Trooper Dan Livingstone of Troop-D and his K-9 partner “Veda” began a track of the driver which took troopers through thick woods and across a stream to the north of the crash scene. Mr. Sprague was ultimately located on River Road in the town of Stratham, where he was taken into custody without incident.

Sprague was placed under arrest, and he was charged with DWI (subsequent offense), Conduct After an Accident, Reckless Operation and two counts of Criminal Mischief. Mr. Sprague is being held on $500 cash bail, and he is scheduled to be arraigned on February 29, 2016, in the 10th Circuit Court, District Division-Brentwood at 0800 hours.

The New Hampshire State Police were assisted at the scene by members of the Exeter Police Department and the Stratham Police Department.

Although alcohol appears to have been factor in the causation of this crash, this incident remains under investigation. Anyone with information pertaining to this incident is asked to contact Trooper Matthew Locke, New Hampshire State Police, Troop-A, at (603)223-8490.

King County:  On March 10, 2016, Washington State Patrol troopers arrested Manoj Siwakoti on an outstanding felony warrant for vehicular homicide and vehicular assault.  The warrants are related to a two-vehicle collision on SR 509/SR 518 on October 24, 2015.  Siwakoti was charged with one count of vehicular homicide and one count of vehicular assault but failed to appear at a mandated court appearance.  He was arrested at his parents residence in Kent.

The collision occurred as the victim (driver) was traveling NB SR 509 to WB SR 518 at approximately 3:00 pm.  Siwakoti, 21 years old, failed to stop at a red light at the intersection and struck the victim’s vehicle while traveling EB on SR 518.  The victim (driver), a 42-year-old female from Burien, died at the scene.  Her 10-year-old son was seriously injured.  Toxicology results showed that Siwakoti was impaired by prescription drugs.

Siwakoti was booked into the Regional Justice Center in Kent on the two felony warrants.

The operator overcorrected as she re-entered the roadway and initiated a counterclockwise rotation. The vehicle continued in a sideway slide through the grass on the south edge of the road before striking a Utility Pole with the vehicle’s left side. After impact, the vehicle rolled onto its roof.

Gabriela J. Beduch, who was not properly restrained at the time of the crash, succumbed to her injuries and was pronounced deceased at the scene. Alcohol is suspected to be a factor in the crash.

Upon arrival, Officers determined that a 1998 Volvo sedan traveling east on 11th Street, driven by Parker John Coggins, 18, of Lakeport, CA, collided with a 2000 Chevrolet Blazer traveling west on 11th Street, driven by a 43-year-old Clearlake Oaks, CA man, causing major front-end damage to both vehicles.

Officers determined that the Clearlake Oaks man had complaints of pain to his stomach, neck, back and left leg and he was transported to Sutter Lakeside Hospital for treatment, by Lakeport Fire Protection District (LFPD) ambulance.

During the investigation, Officers noticed that Coggins was displaying signs and symptoms of alcohol influence and proceeded to conduct a series of field sobriety tests on him which he failed. Coggins was transported to the LPD where he submitted to a blood alcohol content (BAC) test by breath. The results showed that his BAC was .13%. Coggins was booked into the Lake County Jail for felony drunk driving causing injury and he currently remains in custody on bail of $30,000.

This case remains under investigation, but unsafe speed is also believed to be a factor in the collision.

This is Coggins’ second arrest for drunk driving in the City of Lakeport in the past four days. On Friday, March 18, 2016 at about 9:15 PM a Lakeport Police Officer working traffic enforcement in the area of S. Main Street and Lakeport Blvd observed a gray Chevrolet sedan fail to stop at the stop sign at S, Main St and Lakeport Blvd and then travel west on Lakeport Blvd at a high rate of speed. The Officer noticed that the driver, Coggins was displaying signs and symptoms of alcohol influence and that he had beer in the vehicle. The Officer conducted a series of field sobriety tests on him which he failed. Coggins was arrested and booked for driving under the influence of alcohol, driving with alcohol in his blood while under 21 and being in possession of alcohol while under 21.

The LPD is dedicated to keeping its citizens safe by apprehending impaired motorists and encourages members of the community to report all intoxicated drivers.
